Terms of service

Official Terms of Service for clients and commissioners.

FishBone. Art is owned and managed by Heaven Solima

ALL CLIENTS AND COMMISSIONERS ARE TO READ THROUGH THIS TERMS OF SERVICE.
IF COMMISSIONED, IT WILL BE ASSUMED THEY HAVE BEEN AGREED UPON AND THE CLIENT WILL BE HELD LIABLE AS SO.
WE HAVE THE RIGHT TO DECLINE ANY COMMISSION OR SALES IF THEY:

Do not follow these terms
We feel we do not have the ability to do or finish the commission.
We are aware of the client being known for scamming or theft.

Wait time

Please allow up to two weeks before inquiring when your commission will be finished.
This is not because we intentionally delay the piece, but because physical and mental health may delay the working process.

If the client has a deadline for when the work must be finished, it is their responsibility to inform us at time of first contact. Please give at least three weeks notice in advance of said deadline.
We will not rush commissions as we want to give commissioners top quality work.

Refunds

In the case the client is not happy with the time taken, or we feel we cannot complete the piece, a refund can be established.

No refund will be given after we have finished the piece. We will however, be willing to make changes to the final piece if something appears off or if a major design mistake was made on our part.

UP TO 75% of the cost of a commission can be refunded once it has been started.
Clients over pestering about their piece and are not next in line, will be given a full refund and will be blacklisted from future commissions.
A refund will be given if we feel we cannot complete the piece due to difficulty or personal complications. In this case, the client will be given what is finished and will be compensated for what we were unable to complete.

Payment

We take payment plans if the total price is over $50USD. If a payment plan is needed, please inform us in first contact.

If payment is done through PayPal, money will be sent through an invoice for both the clients and our safety.

We will only accept USD currency. Please convert if you use something else.

No client will be charged until a final sketch has been approved.

Payment methods include but not limited to

PayPal
Google Wallet
Steam Game(s) of equal or greater price of your commission
Other online game currencies upon special request
If your payment method is not listed, please ask about it in your first message and we will discuss other forms of payment that work for you.

Waiting list

Please note we do not always go in order based on commissioned date.
Often, quicker and smaller commissions will be finished first.

A link to our to-do list is publicly available on our website and can be requested through messages.
A client is always welcome to ask for a current work in progress to be sent to them.

Personal and copyrighted characters

Any of our personal characters may be requested to be used in your commission.
We have the right to decline your request if we do not like it.

We will draw copyrighted characters and species from media on request and proper credit will be given when uploaded. This includes fan characters or “OC’s”.

What we will not draw

Dirty Diapers. Clean are okay.
Scat/Feces/Gas/Farting/Flatulence of any kind unless in a comedic clean scenario.

Using your commission

The client may upload their commissioned piece to their personal pages for public viewing unless directly requested by us. This applies to any other party featured in the piece as well.
Proper credit must be given when uploading. This includes but not limited too, “@ing” us, posting a link to one of our social media’s, or a link to fishboneart.carrd.co .

If a commission is not lined, colored, or shaded, the commissioner may finish it themselves, or have someone else do it for them if they please.

No person may use our artwork for commercial profit without written consent from Heaven Solima. Any person found using our work for profit will be required to compensate Solima for 100% of the profit or a lawsuit will be filed against them.

Auctions and adoptables

Payment plans may be used in auctions but not flat-priced sales.
A hold can be placed for flat-prices sales on special occasions.
All rules will be listed in the description of said auction.

When an adoptable is fully paid for, the new owner may use the character however they please. This includes but not limited to design changes and re-sells.

A character may not be resold for more than the initial amount purchased unless the character has gained monetary value from other art pieces and the like.

If the buyer files a refund/chargeback, the character design will be reclaimed from the buyer.
The buyer is then forbidden from using the reclaimed designs, and further use will be considered theft and taken care of as such.
